For what incidents can I seek compensation in sport?

Compensation in the course of practising sport may be sought both for pecuniary and non-pecuniary damages.

01. Pecuniary damages are mainly related to the expenses that the injured person incurred in connection with their treatment during a sports activity.

Such are the expenses for medicines, medical examinations, rehabilitation procedures, etc. In the course of active activity, these expenses may be significant in amount; it is important to keep the receipts that prove they were incurred.

02. Non-pecuniary damages, on the other hand, are due for the pain and suffering endured from the incident during the sport.

The amount of compensation for them may vary within a wide range and depends on the duration of the recovery period, the age of the injured person, the degree of recovery, and other facts and circumstances. Non-pecuniary damages may also be claimed because of the inability, due to the injury, to actively practise sports activities.

Who is liable for damages during sports?

The answer to this question depends on where and under what circumstances the incident occurred. If the injury occurred as a result of poorly maintained sports facilities or infrastructure, liability lies with the person who has the obligation to take care of their maintenance and repair when needed. In the case of an open-air fitness area, this will be the municipality as its owner.

If the injury occurred in a fitness centre, liability is borne by its owner. In the event of an incident caused directly by the actions of another person, the latter will be liable for the damages suffered.

What is the procedure for claiming liability?
